ABC News: Judge Strikes Down Controversial Section of Revised Patriot Act:

"A federal judge struck down parts of the revised USA Patriot Act on Thursday,
saying investigators must have a court's approval before they can order Internet
providers to turn over records without telling customers. U.S. District Judge
Victor Marrero said the government orders must be subject to meaningful judicial
review and that the recently rewritten Patriot Act 'offends the fundamental
constitutional principles of checks and balances and separation of powers.' "


I think that this is a strong decision. There must be a way to balance the power of the executive branch, the president needs to have the power to defend the nation. There must be checks to contain that power, we all like to think that our leaders are noble, and maybe they are. However, our government was created to balance power so that even if an abuser of power became president, the president would be checked in their power by other branches of government.
