television character who has used torture techniques such as suffocation and
electrocution on prisoners. "



This is why I fear Giuliani, I am 100 percent against torture, it isn't right and it doesn't work.

not pledge that the administration would continue to seek warrants from a secret
court for a domestic wiretapping program, as it agreed to do in January.
Rather, they argued that the president had the constitutional authority to
decide for himself whether to conduct surveillance without warrants.
As a
result of the January agreement, the administration said that the National
Security Agency’s domestic spying program has been brought under the legal
structure laid out in the Foreign Intelligence Surveillance Act, which requires
court-approved warrants for the wiretapping of American citizens and others
inside the United States.
But on Tuesday, the senior officials, including
Michael McConnell, the new director of national intelligence, said they believed
that the president still had the authority under Article II of the Constitution
to once again order the N.S.A. to conduct surveillance inside the country
without warrants. "


I think this is a clear abuse of Presidential power. If there is honestly a threat, then the process will work to make the case against the threat stronger. Working against the process of law threatens the legality of the case. It also threatens the rights of innocent individuals and guilty individuals.

"FURTHER UPDATE: It's over. House Republicans are proclaiming victory as
Nancy Pelosi and Steny Hoyer have abandoned their effort to change the rules to
allow their majority to operate with more stealth.
Let's give some credit to
conservatives in the House. The conventional wisdom is that in the House, unlike
the Senate, the minority is more or less powerless. But the House Republicans
seem to be well led and to be using effective tactics. They have foiled a number
of pieces of bad and unpopular legislation with motions to recommit; hence
today's effort by the Democrats to change the rules to take that option away
from the minority. "


I think that this is a good thing. The debate seemed to have focused on voting, and how the votes are taken. It seems that Republicans have had success derailing votes in the house by using a motion that would force the votes to go on the record. That means that some Democrats will not vote with their party on issues that are unpopular in their districts. If you ask me, I think every vote should be on the record.

"At issue for Malkin was a video podcast (video downloaded from the Internet) in
which she criticized the rap-music artist Akon, using excerpts from his music
videos and from a performance in which he performed a sexually explicit dance
with an underage girl. Pursuant to the Digital Millennium Copyright Act (DMCA),
UMG, the corporation that represents Akon, gave YouTube notice that it believed
that postings of the podcast violated its copyrights, and thus must be
de-posted. But Malkin -- represented by the Electronic Frontier Foundation --
strongly disagreed, claiming 'fair use,' and arguing that UMG and Akon's true
motive was not to protect creative work, but to avoid harsh criticism.
Yesterday, UMG backed off by rescinding its takedown request. After YouTube got
the word, it allowed the podcast to be posted and viewed.


Hilton,
meanwhile, has been sued by several photograph agencies, including the prominent
X17, for posting copies of their photographs on his site. His attorney, Bryan
Freedman, claims, however, that because Hilton writes words on, and/or
embellishes, the photographs using white pen before he posts them, his use of
the photographs is 'satire,' and thus 'fair use.'
In this column, I'll
explain why Malkin prevailed, and Hilton probably will not. "


This does a great job of explaining fair use, and detailing how it worked to defend Malkin but will work to defeat Hilton.

This story looks to be getting more serious, I believe that Murdoch is a man who is going to do what he says. He is also a man that sees where he can save some money and goes after it. Saving energy is not just good for the planet, it also saves money.

"Gonzales testified in February of 2006 that there had been no such concerns,
but the startling testimony of former Dep. Attorney General James Comey yesterday (video
here) tells quite a different story, including a late-night trip by Gonzales and WH Chief of Staff
Andrew Card to then-AG John Ashcroft's hospital room in hopes of getting his
approval after Comey
would not sign off the program. To his credit, Aschroft refused as well. Even after the White House
--- apparently Bush himself --- called to inform him that Gonzales and Card were
heading over."


I have been attempting to stay out of this row because I don't understand the issues fully. With this break in the case though I think it is time for Gonzales to go. This kind of behavior is not appropriate for someone who has a position of leadership in this country. I don't believe that under the circumstances that have been described most legal documents would be considered legally signed. For example I believe that if this had been an issue of a will and they were attempting to have him sign a will under such duress, it would have been thrown out. It is time for Gonzales to go because he has failed in being a leader and he is losing the respect of the American people.

I don't trust this movement to get cities to vote against political items they have no control over. I don't see how it does anything for the debate, how does it add anything that will help us understand the issue. At its root it is mostly a bandwagon argument, attempting to argue that the whole city is for or against an issue. I would be willing to bet that the City of Arcata, where I live, could easily pass such an motion - but I don't agree with it, so it can't be said to represent everyone in the city. I don't know that it can even be said to represent the majority of the citizens in the city, just the majority of those on the City Council. It is an abuse of power and a pointless abuse of power.

If we are going to embrace this and allow it, we need to accept the fact that it is only a matter of time before towns start voting against supporting abortion, and for conservative issues.

I think that making changes like this is something that shouldn't be done. I thought the same thing when the Republicans wanted to change the rules regarding house debates to favor themselves. If something has remained in place over such a long period, chances are that it has done so for a reason and it is changed with peril.
